OFFICIAL RULES

NO PURCHASE IS NECESSARY TO WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Participation in the Contest constitutes full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements as set forth herein. The “Sponsor” of the Contest is Biotherm Canada, a division of L’Oréal Canada 1500 University St. ,Suite 600, Montréal, Québec H3A 3S7

WHO MAY ENTER: You may enter the Contest if (A) you have a valid email account (B) you are a legal resident of Canada and (C) you are at least Eighteen (18) years of age or older at time of entry. Employees of Sponsor, its parent company and affiliates, as well as their immediate family members (spouse, parents, siblings, and children) and household members of each such employee, are not eligible. The Contest is subject to all applicable federal, provincial and local laws and regulations.

ENTRY PERIOD: The Entry Period begins at 9:01 a.m EST March. 7th, 2013 and ends at 11:59 a.m. Eastern Standard Time March 17th, 2013. Limit one entry per person.

HOW TO ENTER: To enter the Contest entrants must do the following:

Sponsor is not responsible for any failure the Site, or the Submission Form during the Entry Period including any technical malfunction of any computer, on-line system, server, access provider, computer equipment, or software on account of traffic congestion on the internet, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from downloading any material related to the Contest, all of which may affect a person’s ability to participate in the Contest.

ODDS OF WINNING: Odds of winning are based on eligible number of entries.

SELECTING THE WINNER: There will be one hundred (100) winners (the “Winners”).

On March 18^th., Sponsor shall draw 100 winners from all the entries received by March 18^th 11:59 am EST.

PRIZES: The Winner will receive a full size Blue Therapy Eye  product. (total value: $55)

All federal, provincial and local income taxes, insurance, licensing, registration and title fees connected to a prize are the sole responsibility of the Winner and Runner Up (collectively the “Prize Recipients”). All federal, provincial and local laws and regulations apply. Sponsor shall only be responsible for awarding the number of prizes as stated in these Official Rules. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of a prize awarded. Sponsor makes no representation or warranties concerning any prizes awarded. Lost or stolen gift cards shall not be replaced.

CLAIMING PRIZES: CLAIMING PRIZE

The prize must be accepted as described in these rules and regulations, and may not be transferred to another person, substituted for another prize or exchanged in part or in full. Despite the above, in the event that, for reasons not related to the winner, the contest organizer cannot award the prize, or a part thereof, as described in these rules and regulations, they reserve the right to award a prize that they deem equivalent.

The refusal by a person selected as a winner to accept the prize, or a part thereof, according to the conditions set forth in these rules and regulations releases the contest organizer of any obligation relating to this prize or this portion of the prize towards this person.

In order to obtain the prize, the selected entrant must first, in addition to meeting the contest eligibility criteria and complying with the official contest rules and regulations (the “Winner”):

Delivery of prize

The selected entrant must follow and respect the instructions and procedures communicated by the Partner and its representatives in order to receive his or her prize.

Disqualification

If any of the conditions stipulated above are not met, the selected entrant will be disqualified and shall not be entitled to receive any prize, in which case the Partner reserves the right, at its sole and absolute discretion, to select at random another eligible entrant as the potential prize winner.

GENERAL CONDITIONS

The Winner must release the contest organizer and the contest partners, as well as any

person designated by them, of any responsibility with regard to any damages that may be

suffered as a consequence of accepting this prize, or the organizing or holding of the activity described in the contest. The failure or refusal of the Winner to give effect to this section will release the contest organizer of any obligation to award this Winner any prize whatsoever.

By entering this contest, all entrants consent to having his or her name and photo used for compensation.

The odds of being declared a winner, for contest entrants, will depend on the number of valid entries received at the time of the draw. 

The contest organizer reserves the right to eliminate, at its discretion, entry forms sent by group (spamming) and those of doubtful origin.

The contest organizer reserves the right to disqualify any person or cancel the entry of any person entering this contest or attempting to enter this contest by means that are contrary to these rules and regulations. According to the nature of the act, this person may be referred to the legal authorities, as the case may be.

All entry forms become the property of the contest organizer and no communication will be exchanged with the entrants as part of this contest other than in compliance with these rules and regulations or on the initiative of the contest organizer.

For the purposes of this contest, the entrant is the person whose contact details appear on

the electronic form sent to the contest organizer.

The contest organizer, the contest partners, their subsidiaries, their employees, agents and representatives, are not liable for the incorrect operation of any IT component, software, or line of communication used to transmit the electronic form, or any transmission that is defective, incomplete, incomprehensible or erased by any system, computer or network and that may limit the possibility of or prevent any person from entering this contest.

The contest organizer, the contest partners, their subsidiaries, their employees, agents and representatives are also not liable for any damages or loss that may be caused, directly or indirectly, in full or in part, by the downloading of any Internet page, software or form, or by the transmission of any information regarding participating in this contest.

The contest organizer reserves the right, at its sole discretion, to cancel, end, modify or suspend this contest in full or in part in the event that an event, error or human intervention of any sort occurs that may corrupt or affect the administration, security, impartiality or conduct of the contest as set forth in these rules and regulations, subject to approval by the Régie des alcools, des courses et des jeux du Québec, if required.

The contest organizer does not in any way guarantee that these websites and/or servers, as well as those of its contest partners, suppliers and/or other websites used for the purpose of this contest, will be accessible or functional without interruption throughout the entire contest period or

that they will be free of error. In the event the entry forms cannot be sent, for any reason

whatsoever, the contest organizer, the contest partners, their subsidiaries, and their employees, agents and representatives cannot be held responsible.

By entering this contest or attempting to enter it, each entrant and/or attempted entrant agrees to release, indemnify, and forever hold harmless the Partners and their directors, managers, employees, shareholders, agents, or other representatives (together, the “Indemnified Parties”) of all claims, actions, damages, means of action, causes of action, lawsuits, debts, duties, accounts, bonds, agreements, guarantees, indemnities, contracts, or liabilities of any kind whatsoever resulting from or related to entry or attempted entry in this contest, compliance or failure to comply with these contest rules, or the acceptance or use of the prize. The Indemnified

Parties will not be held responsible for lost, incomplete, late, or misdirected entries, or for any problem with the platform during the contest period, or for any technical malfunction or other problem with the telephone lines or networks, the online IT systems, the servers, the Internet access providers, the equipment or software or any other technical problem or problem with Internet traffic or the website, or any combination of the above, and will not be held responsible for any injury or damage to any person or property resulting from or related to entry or attempted entry by this person or any other person in this contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

All decisions of the contest organizer regarding this contest are final and binding, subject to approval by the Régie des alcools, des courses et des jeux du Québec on any matter under its jurisdiction.

If a section of these rules and regulations is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

7.15 For Quebec residents, any disputes respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
